Immigration Regulations

On September 5, 2022 new immigration regulations were introduced where residency visas have several new categories. Residence permits include

  • Residence permit for contractual employment sponsored by Employer that requires MOHRE approval and an employment contract
  • Green Visa - 5 year self sponsored residence permit
    ii. for Investors,
    i. Highly Skilled Workers and
    iii. Freelancer Visas

If the employer company does not have established presence in the UAE employees can work with a global PEO as the Employer of Record in UAE

Employees can sponsor family members once they have received their own Resident Visa

Eligibility

  • Must have a job offer from Employer
  • Employer must have valid business license and Must have not Broken Any Law
  • Employer must shoulder the cost of any visa fee.
  • Skilled workers must have a Bachelor's Degree
  • Unskilled Workers must have Trade Qualifications with 2-o 3 years relevant work experience.

Visa Requirements for Indian Citizens

  1. Employer applies for approval from Ministry of Labor to hire foreign employee
  2. The Ministry issues an entry permit visa - initial stay permitted is 30 days aka Pink VISA.
  3. On arrival of employee, employer begins process of applying for Labor Card
  4. On Arrival employee has 60 days to obtain residence visa.
    a. Employee visits Emirates ID center to obtain ID with valid passport and entry visa
    b. Employee goes to government hospital for medical examination <
    c. Employee applies for residence visa through Immigration Authorities
    i. Employee brings all documents to DNRD

MoHRE in UAE issues 12 types of work permits in which employers registered with MoHRE are allowed to recruit employees depending on the nature of the job.

  • a work permit to recruit a worker from outside the UAE
  • a work permit to transfer a foreign worker from one establishment to another
  • a work permit for a resident on a family sponsorship
  • a temporary work permit to hire a worker to complete a job within a specific period
  • one-mission work permit to recruit a worker from abroad to complete a temporary job, or a particular project for a specific period
  • a part-time work permit to recruit a worker under a part-time contract where his working hours or days are less than his full-time contract
  • a juvenile permit to recruit a juvenile between 15 and 18 years
  • a student training and employment permit to employ a 15-year old student who is already in the UAE
  • UAE/GCC national permit to employ a UAE or a GCC national
  • a golden visa holder permit to employ a worker holding the UAE’s Golden Residence visa
  • national trainee permit to train a UAE national
  • a freelance permit issued to self-sponsored foreigners in the UAE, who provide services or perform tasks to individuals or companies (without being sponsored by establishment)

Cost of Work Permits Rangies from AED 250 to AED 3,450 depending on classification of company which is A, B or C. The classification of company reflects upon the extent of compliance with UAE labor law, Wage protection system and MoHRE directives,. Company with a history of violations and lack of commitment will be placed in category C
