EB5 is an investment visa that is pathway to green card/permanent residence to the United States. It is one of the costliest investment option compared to other countries offering permanent residence based on investment.
There are four steps in EB5 petitioning process that must be completed to become US permanent Resident; along with spouse and unmarried children under the age of 21.
- Select a Qualifying EB5 project that must meet program requirements
a. Can get faster processing offered by expedited approval (takes 6 months) and
b. Rural premium processing - 20% projects in this area (takes at least a year)
- EB5 applicants are required to make an investment of
a. $1,050,000 at least or
b. $800,000 if the job creation occurs in a Targeted Employment Area into a US business venture. TEA applies to projects in rural areas or high unemployment areas.
- Investment must result in 10 full time US jobs to qualify for EB 5 - indirect and induced jobs are allowed.
- To make an investment, investors will
a. Sign subscription agreement
b. Request to join a partnership or an LLC
c. Manager or GM will then accept the investor
d. Funds will be wired into an investor account controlled by escrow agent
e. EB 5 petition will be filed
- Funds must be acquired lawfully and lawful source and path of funds is required
- Credible Business in the eyes of the USCIS and must meet all “Matter of Ho” requirements.
- Funds must go into an NCE and must create at least 10 new full time jobs
- Investor capital must be “at risk” with a chance of gain or loss without guarantees on ROCE
- Denial refund guarantee may be offered to investors and the terms of refund must be included in the documentation. It is important to identify who is offering the guarantee and the guarantor has the means to deliver on the repayment promise, especially if project gets denied
- If approved 2 years permanent residency is granted either
- By adjustment of Status if in the United States
- By filing DS-260 with the Embassy of the country of origin if outside the United States
- Applicant becomes unconditional permanent resident by filing for removal of conditions.
- Five years from the date of conditional permanent residency, investor is eligible to become citizen of the United States/
